Navigating Property Transactions in Mexico

The Notary Public undertakes an important legal role in Mexico. This is your most important contact for property transactions.

While some buyers hire lawyers to ‘oversee’ their property transactions in Mexico, only the Notary Public has the legal power to process the necessary papers and to ensure that legal title is properly passed from seller to buyer.

Whether you hire a lawyer or not, the Notary Public is the most important legal person you will deal with when you make a property investment in Mexico. Under Mexican Law, the deed to the property must be prepared and processed by a Notary Public.

As a buyer, it is your right to choose the Notary Public.

*Important tip: If you are the buyer in a property transaction, it is your prerogative to choose the Notary Public, and we strongly advise that you choose with care one who is completely independent of the seller’s influence or recommendation.

For the protection and security of our clients, we recommend that a Lawyer gets involved at the very beginning of the real estate transaction before any documents are signed and any funds change hands.

“Real Estate is a complex transaction.”

The lawyer represents you and is there to protect your interests moving forward with your real estate purchase.

The lawyer will complete their due diligence, starting from the offer to purchase through to the final closing. Some of the important things that a Lawyer will conduct on your behalf:

  1. Review the terms and transactions requested from the selling party
  2. Prepare the Promise of Sale Contract protecting your interests
  3. Verify the developer's documentation
  4. Verify title, taxes, leans
  5. Confirm that the property may be titled
  6. Coordinate with Notary Public, bank
  7. Provide recommendations proceeding forward

We have aligned our company with MEXLAW to provide our clients with a secure and professional International Legal Firm for your transaction of real estate.
